What's the law base for the system of the Work Permit for Foreigners?

《中華人民共和國出境入境管理法》第四十一條規定，外國人在中國境內工作，應當按照規定取得工作許可和工作類居留證件。任何單位和個人不得聘用未取得工作許可和工作類居留證件的外國人。

According to Article 41 under the Exit and Entry Administration Law of the People’s Republic of China, foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

2、哪類外籍人士需要辦理來華工作許可？

Who need to apply for work permits?

熊猫体育任一單位聘用的，來華工作（全職或兼職）90日以上的外籍教師、科研人員☂️、行政人員以及外事博士後都需辦理來華工作許可👇🏻。

Foreigners who work in DHU as teachers, researchers, administrative staff and post doctors for more than 90 days (full-time or part-time) need to apply for the work permits.

3、申請來華工作許可的基本流程是什麽？

What’s the basic process for applying for the work permit?

一般需要四個步驟：（1）國際合作處為外籍人士申請《外國人來華工作許可通知》（2）外籍人士申辦工作簽證入境（3）國際合作處為其申請《外國人來華工作許可》（4）外籍人士領取工作許可證後(或同時)申請工作類居留許可。

Generally, it takes four steps：

4、對於已經在中國境內的外籍人士，何種情形可以直接申請外國人來華工作許可?

For forefingers already in China, under what circumstances can they apply for the work permits directly without getting the Notification Letter for Foreigners’ Work Permit?

以下幾種情況可以直接申請工作許可，其他情況需具體分析🎞。

（1）持其他簽證或有效居留證件已入境的外國高端人才（A類）

（2）在華工作的外國人變換用人單位，但工作崗位（職業）未變動，且工作類居留許可在有效期內的

（3）中國公民的外籍配偶或子女🏃🏻‍♂️、在華永久居留或工作的外國人的配偶或子女，持有效簽證或在有效期內的居留許可的

（4）已獲得來華工作90日以下的外國人來華工作許可的🤹🏽🤠，在其停留有效期內，被境內用人單位依法聘用的

Foreigners under the following circumstances can apply for the work permits directly. Specific analysis is needed otherwise.

(1) High-end foreign talents (Category A) have entered into China with other visas or valid residence permits

(2) Foreigners change employers in China while the positions are similar and have valid residence permits

(3) Spouses or children of Chinese citizens or of foreigner with permanent residence permits, meanwhile holding valid visas or residence permits

(4) Foreigners have obtained work permits of less than 90 days and are employed in China during their stay.

5🫨、申請來華工作許可需要多長時間？

How long does it take to apply for the work permit?

一般來說，入境前申請《外國人來華工作許可通知》和入境後申請《外國人來華工作許可》各需10-15個工作日(各類材料準備時間不計入在內)。

It unusually takes 10-15 working days to get the Notification Letter of Foreigner’s Work Permit before the foreigner enters into China, and also 10-15 working days to get the work permit after entry. (The time for documents preparation is not included.)

6、外籍博士後要辦理來華工作許可嗎？

Do post doctors need to apply for the work permits?

需要🙇‍♀️。在完成校內進站流程後辦理💪🏼。

Yes. Post doctors shall apply for the work permits after the university recruitment procedure is finished.

7、體檢證明可以是任意醫院出具的嗎𓀀👨🏼‍🔬？

Is it qualified that health certificates issued by any hospitals?

申請人體檢證明必須是由中國檢驗檢疫機構出具的境外人員體格檢查記錄驗證證明或健康檢查證明書🤑，簽發時間在6個月內。上海國際旅行衛生保健中心是指定機構之一，也可咨詢出入境管理局了解更多指定醫院👩‍🏫。申請人如在6個月內在境內外其他醫院做過體檢，或可帶著體檢報告至指定醫院替換🧑🏼‍🤝‍🧑🏼。 

The certificate of health examination for foreigners must be issued by China’s inspection and quarantine authorities within six months.

Shanghai International Travel Healthcare Center (https://online.shhg12360.cn/sithc/sithcen/) is one of them. For more qualified hospitals, please consult with the exit-entry administration bureaus in Shanghai.

Foreigners who have received health examinations within 6 months in other hospitals in and outside China may bring the reports to the designated hospitals for substitution.

8🥿、可以在上海以外的地區申請來華工作許可嗎👊？

Can foreigners apply for the work permits in other places instead of Shanghai?

不可以，原則上應在單位所在地區申請來華工作許可♚。

No. Work permit should be applied for where the employer locates in principle.

9🧑🏽‍🦰、B類外籍人士者哪些情況可以免無犯罪記錄證明🖍？ 

Under what circumstances can foreigners of Category B be exempt from submitting certificates of no criminal record?

（1）原則上工作類居留許可在有效期內可以免無犯罪記錄證明； 

（2）如外國人更換單位，公安出入境已將工作類居留許可註銷👂，並換成了停留簽證，如外國人未出境，且工作類居留許可註銷一個月內🙇，也可免無犯罪記錄證明🎫。 

(1) Foreigners have valid work-type residence permits

(2) Foreigners change employers while their work-type residence permits have been canceled and substituted by stay permits for no longer than 1 month

11、實習經歷可以計入相關工作經歷嗎？

Can internships be counted as related work experience?

工作資歷證明不能是兼職或是實習經歷，必須是全職工作經歷。如果同一時間段內既有學習經歷又有工作經歷🦟🚶，單位的開具的工作資歷證明必須註明是否全職工作。 

Internships or part-time jobs cannot be counted as work experience. Only full-time jobs are recognized. If the period of work overlaps with the period of study, foreigners shall ask their formal employers to note clearly on work certificates that it is full-time job or not.   

12、申請時要求填寫的“辦理簽證地點”不確定，任意填一個可以嗎？

If “the Place of Applying Visa” is uncertain, can foreigners fill in a possible one?

不可以，在填寫前務必和當地中國駐外使館🧙🏻‍♂️♌️、簽證辦理中心確定簽訂辦理點的具體名稱♢。如果系統填寫的地點錯誤📤，則無法在實際簽證辦理點查到您的《來華工作許可通知》信息，無法辦理簽證。

No. If foreigners are not sure, do consult with the local embassies or visa centers about the exact names and locations of the places before filling the information. If the information of a wrong place is filled in, the embassy or visa center where the foreigners go will not accept their visa applications.

13🪱、外籍人士獲得《外國人工作許可通知》後，是否還需要辦理邀請函？

Do foreigners with the Notification Letter of Foreigner’s Work Permit still need invitation letters to come to China?

不需要，可以憑《通知》到駐外使✹🏋🏽、領館辦理簽證 

No. Invitation letters are unnecessary in this case. Foreigners can apply for Z visas with the Notification Letters directly.

14、所有申請材料都需要原件嗎🙈？

Do all documents for application need to be original?

盡管並不是所有外籍人士都需要提交原材料進行核驗🧜🏼，但是所有申請材料都應為原件並帶到中國🏊🏽。詳情請查閱國際合作處“外國專家”欄的來華工作許可申請指南。

Although not all foreigners have to submit original documents for examination, all application documents should be original and it is suggested that applicants bring all the original documents when coming to China.

15、外籍人士居留許可要去哪裏申請？有沒有咨詢電話？

Where do foreigners go to apply for residence permits? Is there a hotline for consultation?

一般來說，外籍人士可以在上海任意出入境管理局申請居留許可🐱🧖🏼。但是一些緊急情況或特殊情況下👆🏿，可能會被要求去浦東的出入境管理局辦理。咨詢熱線🫴🏿：28951900。

Usually, residence permits can be applied for in any exit-entry administration bureaus in Shanghai. Foreigners may be required to go to the bureau in Pudong for emergent or special cases. Service hotline: 28951900.

16🤌🏿、工作許可已經過期，可以再申請延長嗎？

Can a foreigner apply for extension of the work permit if it has already expired?

不可以👨🏼‍🔬。工作許可到期前1個月必須在線提交延期申請⟹🤶🏽。請務必提前2-3個月聯系國際合作處開始準備延期所需材料。如果工作許可已經過期，則無法按照延期流程來辦理🧰，須重新申請工作許可證。

No. Application for extension of the work permit must be submitted online 1 month ahead of the expiration date. Please contact ICO for extension application 2-3 months in advance. If the work permit expires, one cannot applies for extension but only to start over for a new work permit.

17🉑、如果外籍人士的護照更新👞、變更崗位了、個人信息變化了⛹🏻‍♂️，對工作許可和居留許可有影響嗎？

If a foreigner’s passport number, occupation or other personal information is changed, how to deal with the work permit and the residence permit?

外籍人士個人信息（姓名🥛、護照號、職務🐦、類別）等事項發生變更的🏚，應當自變更事項發生之日起10個工作日內聯系國際合作處申請變更工作許可和居留許可🧺✍🏻。具體請查閱國際合作處官網“外國專家”欄的辦事指南。

19、如果外籍人士在工作許可失效前離職🤹🏻‍♂️，工作許可和居留許可怎麽處理？

If a foreigner resigns before the expiration date of the work permit, how to deal with the work permit and residence permit?

如提前離職，離職後10日內需要將工作許可以及工作類居留許可註銷。

One shall have the work permit and the work-type residence permit canceled within 10 days after resignation.

20🏄🏻、外籍人士取得《外國人在華永久居留證》，還要辦理《外國人來華工作許可證》嗎？ 

Do foreigners with permanent residence permits need to apply for the work permits?

不需要。

21🐖🙅‍♂️、外籍人士如果超過60歲還能申請嗎👨🏿‍🚒？ 

Can foreigners over 60 years old apply for the work permits?

外國高端人才年齡無限製🏂🏿，其他類別一般不可超過60周歲。對於超過60周歲的外國高端人才，用人單位須為其購買在華工作期間的保險，並提交相關承諾書👃🏿。

Foreigners of high-end talents (Category A) over 60 years old can still apply for the work permits, while foreigner of other categories over 60 years old cannot. The employer must buy them insurance that cover their stay in China and submit related commitment letters.
